• 1.) Introduction
• 1.1) PlusSkills the language learning platform has its registered office at Near MDS University, Kayad road Ajmer, We provide online courses and conduct online classes, live demo, and doubt-solving sessions for the students seeking to enrol for such courses which Services are accessible at www.plusskills.in, Consumers can use this program from anywhere and with any device.

 

1.2) By accessing or using the Site, Services or by downloading any content from or on the Site, via the website, you would be indicating that you have read and that you understand and agree to be bound by these terms and receive our Services (“ Terms of Services” or “Terms”), whether or not you have registered with the website.

 

• 1.3) Therefore, please read these Terms of service before using any services, carefully as they contain important information regarding your legal rights, remedies and obligations.

 

1.4) If you do not agree to these Terms, then you have no right to access or use the Site, Services, or Collective Content (as defined below).

 

• 1.5) If you are using the Site, Application or Services then these Terms of Service are binding between you and PlusSkills2. Definition
• 2.1) In addition to other words and expressions that may be defined elsewhere in these Terms, unless the context otherwise requires, the following capitalized terms wherever used in the Agreement shall have the meanings as ascribed hereunder
• 2.2) Educational courses are listed on the Site or Application.
• “Course Fees”  are due and payable by a Student for enrolment of the Course.
• “Course” The course duration will be as per the packing course. Classes will be scheduled on alternate days, regular and twice a week. The duration of the classes will not be expanded due to any reason. 
• Each class duration will be 60 to 90 minutes.
• Sunday class will be an activity lesson.

  Trainer” means a Member who has been selected by PlusSkills in order to provide services through the Site

 

“Student ” means a Member who enrols for Courses on Site, in the case of a minor student the parent or guardian who enrol their child or ward for the Courses on Site.

 

• “Tax” or “Taxes ” mean any sales taxes, value-added taxes (VAT), goods and services taxes (GST), or service tax, that PlusSkills may be required by law to collect and remit to governmental agencies, and other similar municipal, state, federal and national indirect or other withholding and personal or corporate income taxes.

“Payment Method” means a payment method that you have added to your PlusSkills, such as a credit card, debit card, net banking or UPI.

3. Terms of Service

3.1) We believe that every user of our Services/products/Website must be in a position to provide 

informed consent prior to providing any Information required for the use of the Services/products/Website. By registering with us, you are expressly consenting to our collection, processing, storing, disclosing, and handling of your information set forth in our Privacy Policy now and as amended by us. Processing, your information in any way, including, but not limited to, collecting, storing, deleting, using, combining, sharing, transferring, and disclosing information, all of which activities will take place in India. If you reside outside India your information will be transferred, processed, and stored in accordance with the applicable data protection laws of India.

3.2 By using the Site or Services, you agree to comply with and be legally bound by the 

terms and conditions of these Terms, whether or not you become a registered user of the Services. These Terms govern your access to and use of the Site, Application and Services and all Collective Content (defined above), and constitute a binding legal agreement between you and PlusSkills. The user further accepts to allow PlusSkills language learning platform to reach them through Call, SMS, Email, and Whatsapp for providing existing services and for providing information on new products and services and it will supersede the registry of NDNC & DND as per the regulation of TRAI under the guidelines of TCCPR

3.3) I hereby authorize to receive SMS, Whatsapp, Email and other communications via PlusSkills 

and it supersedes the registry of NDNC & DND as per the regulation of TRAI

3.4) In addition, certain areas of the Site (and your access to or use of certain aspects 

of the Services or Collective Content) may have different terms and conditions, standards, guidelines, or policies posted or may require you to agree with and accept additional terms and conditions. If there is a conflict between these Terms and conditions posted for a specific area of the Site, Application, Services, or Collective Content, the latter terms and conditions will take precedence with respect to your use of or access to that area of the Site, Services, or Collective Content.

3.5) If you do not agree to these Terms, you have no right to obtain information from or otherwise 

continue using the Site, Application or Services. Failure to use the Site, Application or Services in accordance with these Terms may subject you to civil and criminal liabilities.

3.6) The Site, Application and Services comprise an online platform which creates Listings for 

Courses and Students may learn about and enrol for the course directly through the Site and Application.

3.7) You acknowledge and agree that, by accessing or using the Site, Application or Services or by 

downloading or posting any content from or on the Site or via the Application, you are indicating that you have read and that you understand and agree to be bound by these Terms and receive our Services, whether or not you have registered with the Site and Application. If you do not agree to these terms, then you have no right to access or use the Site, Application, Services, or Collective Content. If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity.

3.8) Any violation by You of the terms of this Clause may result in immediate suspension or termination of Your Accounts apart from any legal remedy that the Company can avail. In such instances, the Company may also disclose Your Account Information if required by any Governmental or legal authority. You understand that the violation of these Terms could also result in civil or criminal liability under applicable laws.

3.9) The Company has the right to change modify, suspend, or discontinue and/or eliminate any aspect(s), features or functionality of the Application or the Services as it deems fit at any time without notice. Further, the Company has the right to amend these Terms from time to time without prior notice to you. The Company makes no commitment, express or implied, to maintain or continue any aspect of the Application. You agree that the Company shall not be liable to You or any third party for any modification, suspension or discontinuance of the Application/Services. All prices are subject to change without notice.

4.0) You acknowledge that Your ability to use Your account is dependent upon external factors such as internet service providers and internet network availability and the Company cannot guarantee accessibility to the Application at all times. In addition to the disclaimers set forth in the Terms, the Company shall not be liable to You for any damages arising from Your inability to log in to Your account and access the services of the Application at any time.

4.) Payment Terms

• 4.1) The Platform is a paid service and the payments made by You shall be according to the plans opted by You through the Platform. There are lots of courses as per child knowledge and requirements.
• 
  4.2) Our team will suggest the course accordingly parents can opt. You explicitly agree to pay the fees for the courses/ plans that you purchase, and you authorize the Company to charge you as per the applicable payment mode opted by you. All payments shall be through the payment mechanism put in place by the Company and You shall be responsible for paying all fees and applicable taxes in a timely manner as per the mechanism associated with the Plan availed by You. Users have been given various options to choose and proceed with the payment for the Services via payment mechanisms including but not limited to Card Payment facilities, EMI Payment, Online Bank Transfer and Wallet Payment. With reference to Section 10, the payment gateway mechanisms are governed by the terms and conditions of the third-party providers as listed on the Platform and the User agrees to be bound by those terms.
• 4.3) Valid Credit / Debit/ Cash Card/ online bank transfers and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms agreed to between the Users and the respective issuing bank and payment instrument issuing company. We shall not be liable for any unauthorized use, fraud, payment refunds, lost amount etc. in the transaction. The amount of refund payable shall only be limited to the amount paid by the User for Services which were not rendered to the User by Us. In case of a refund of EMI transactions, the User will be charged interest as per the bank’s regulations.
• 4.4) We attempt to process and complete refund requests within 24 hours from the time of receiving the refund request, however, in case there is any delay in refund beyond the period of 72 hours, then you may notify us at info@plusskills.in. The refund process may include a feedback call to you and validation of key information that may be required by us to process the refund request.
• 4.5) We reserve the right to change any fees at any time at our sole discretion and any change, update, or modification in the fee shall become effective immediately upon the same being posted/uploaded or notified on our website.
• 4.6) The only registration fee will be charged for Mass- Class. Once a fee is paid will not be refundable.

Cancellations and Refunds

• If, as a student, you wish to cancel a confirmed enrolment made via the Site or the Application, after enrolment to the Course, the cancellation policy contained in the applicable Listing will apply to such cancellation provided that no refund will be made in respect of tuitions already provided. Our ability to refund the Course Fees and other amounts charged to you will depend upon the terms of the applicable cancellation policy and financial charges applicable in case of course payment through No Cost EMI options. Details regarding refunds and cancellation policies are available via the Site and Application. Plusskills will initiate any refunds due pursuant to the Payments Terms. The amount will be possible to refund if the child/parent will cancel the course within 1 week of the joining date.
• The course will be discontinued if students will be part of any misbehaving or illegal activities. In this case, Plusskills will not refund any amount of the fee.

• If We cancel a confirmed enrolment made via the Site, Services, and Application, (i) Plusskills will refund the Course Fees paid by the Student for such enrolment to the applicable Student pursuant to the Payments Terms which shall not exceed the total amount paid by the Student.

5.) Trial Classes

5.1) We offer One (1) free trial class to our new members so that you get an opportunity to experience the services provided by us.

5.2)  Only one (1) free trial class is permitted per new student. Multiple availment of trial classes by an individual either through his/her own account or through someone else’s accounts, email IDs and/or in any other manner whatsoever, without the prior written permission of the Company is not allowed and shall amount to a breach of the present Terms.

5.3) Any free trial class provided by the Company shall also be governed by these Terms.

6.) Entire Agreement

This Agreement, along with the Privacy Policy, Terms of Use, and any additional guidelines, rules, and/or disclaimers posted on the Platform constitutes the entire agreement governing your use of our Platform and supersedes any prior agreements, if any, relating to any matter dealt within this Agreement.

7.) Termination

Without limiting any other rights that Company may have, Company may remove, restrict, cancel or suspend access to and/or use of the Platform, Services provided by the Company and any part of it, if Company considers (in the sole discretion of Company) that You have breached any of these Terms.

You may also terminate your agreement with the Company by ceasing to access the Platform, Service, deleting all copies of the Service or part thereof within your control. Termination shall not affect any rights or remedies, which have accrued up to the time of termination.

Consequences of Termination

• If we take any of the measures described above we may (i) communicate to the Students that a pending or confirmed enrolment has been cancelled, (ii) refund the Students in full for any and all confirmed enrolments, irrespective of pre-existing cancellation policies, (iii) support the Students, on an exceptional basis, in finding potential alternative Courses, and (iv) you will not be entitled to any compensation for confirmed enrolments that were cancelled.

• If You or We terminate this Agreement, we do not have an obligation to delete or return to you any of your Member Content, including but not limited to any reviews or Feedback. When this Agreement has been terminated, you are not entitled to a restoration of your Plusskills Account or any of your Member Content. If your access to or use of the Site, Application and Services has been limited or your Plusskills Account has been suspended or this Agreement has been terminated by us, you may not register a new Plusskills Account or attempt to access and use the Site, Application and Services through other Plusskills Accounts.
